President Karzai’s Decree

Kabul (BNA) Hamid Karzai the president of the Islamic Republic of Afghanistan on the occasion of International Women Day, March 8th issued a decree which includes reducing the jail term and pardoning juvenile girls and women prisoners.
The decree which issued in accordance with 18th clause of article 64 of the constitution covers the juvenile girls and women detainees as follows:
Article one:
1- The jail term of juvenile girls who are sentenced to five years imprisonment reduced to four years.
2- Six month reduction brings to those juvenile girls who are sentenced to prison from one to five years.
3- Three months reduction is given to those juvenile girls who are sentenced to one year prison.
4- The juvenile girl inmates completed their term with counting the period of pardoning would be released.
5- Reduction in prison term of inmates:
Article two:
1- One and half year reduction is given to those women whose jail term is more than 10 years.
2- One year reduction is given to those women whose jail term is more than five years up to 10 years.
3- Six month reduction is given to those women whose jail term is one to five years.
4- Three months reduction is given to those women whose jail term is one year.
5- The women inmates completed their term with counting the period of pardoning time would be released.
The impact of pardoning and reduction in jail term
Article three:
Reduction and pardoning the punishment of inmates envisaged in the Presidential Decree does not include the ruling on compensation and cash fine.
Article four:
The ministry of women affairs has been authorized to keep those women and girls whose close relatives are not available during their release and to inform their families unless their close relatives arrive.
Implementing authority,
Article five:
1- Provincial commission which consists of prosecution as head of the commission, representative of national directorate for security as member, head of prison for women and juvenile as member, representative of independent human rights commission of Afghanistan as member, representative of women affairs ministry as member.
2- The authorized commissions are responsible to implement the decree with keeping in mind the background of the prisoners.
3- The commissions are responsible to report about the beneficiary of the inmates including women and children to the ministry for interior, ministry for justice, administrative affairs directorate and secretariat of council of ministers.
4- The directorate for monitoring implementing the decrees would monitor the execution of the decree.
Article 5-6:
The decree is effective from Hoot 17, 1392 and applicable to those who receive court ruling until that date.
